Britton Monts, AV-rated and recognized in the past as a Texas Super Lawyer by Texas Monthly Magazine, has been practicing law for over thirty years. He has tried and handled cases across the state of Texas and the U.S. He began his practice in West Texas in 1984 with the Midland law firm,Lynch, Chappell and Alsup. In 1989, he moved to Dallas to run the firm's litigation section there. In 1993, he started his own firm to focus exclusively on representing individuals and small companies against larger and wealthier companies, fulfilling his vision of a firm dedicated to fighting for the underdog. In 1999, he co-founded Monts & Ware LLP.

Britton has extensive experience handling complex civil cases, including consumer class actions over late fees and other surcharges, wrongful death/serious personal injury cases and oil and gas disputes. He has filed and successfully resolved numerous class action lawsuits around the country, most involving consumer abuse, and also has successfully concluded numerous wrongful death/catastrophic personal injury cases, employment cases and other legal disputes.

Since 2013, he has taken on the apartment industry in Texas, challenging late fees and utility surcharges, settling so far at least ten such class actions and returning sums totaling millions of dollars in the form of checks paid to tens of thousands of current and former Texas apartment tenants.

As part of his commitment to the environment and property owners' rights, he served as co-counsel in over a dozen class actions filed in North Dakota against large oil companies for allegedly unlawful and wasteful flaring (burning off) of natural gas into the atmosphere. NASA photos taken at the time showed the flares were visible from space. During the course of that litigation, which received national news coverage, gas flaring in North Dakota dropped significantly.

Also, he has represented victims of SLAPP suits (strategic lawsuits against public participation) to protect First Amendment liberties for people who speak out on issues or assert their legal rights against large companies.

In 2000, Britton Monts and Tom C. McCall, as co-trial counsel, won a landmark land fraud verdict (later settled) on behalf of the Balli family in South Texas, ultimately recovering by way of settlement, land and money taken from the family decades earlier. It is believed to be the first and only successful lawsuit of its kind. His cases over the years have been varied and many have involved difficult and novel issues.

Britton received his undergraduate degree from Abilene Christian University in 1980 graduating magna cum laude with a degree in accounting, and his law degree from SMU in 1984 where he was a member of the Journal of Air Law & Commerce and published two articles on aviation law.

In 1988, he was selected the Outstanding Young Lawyer of Midland County in connection with his efforts to establish a pro bono legal clinic in that community.

He has been interviewed by the national and local media about his cases and legal issues on numerous occasions.

Besides his legal career, Britton enjoys travel, music, reading, hiking and climbing, and spending time with his family.
